Battery Domestic Violence

A seemingly small argument can escalate quickly between married couples, boyfriends and girlfriends, or relatives and before you know it the cops show up and you are being charged with Battery Domestic Violence. A domestic violence charge is taken very seriously in the state of Nevada. Consequences include the loss of your right to own a firearm, negative consequences in a custody dispute of your children, possible loss of employment, and even deportation if you are not a U.S. citizen. In addition, penalties based on the number of offenses are:

1st Offense: At least 2 days in jail but not more than 6 months, at least 48 hours but not more than 120 hours of community service, a fine of not less that $200 nor more than $1,000 plus administrative assessments and participation in weekly counseling sessions of not less than 1 ½ hours per week for not less than 6 months nor more than 12 months at your own expense;

2nd Offense in 7 years: At least 10 days in jail but not more than 6 months, at least 100 hours but not more than 200 hours of community service, a fine of not less than $500 nor more than $1,000 plus administrative assessments and participation in weekly counseling sessions of not less than 1 ½ hours per week for 12 months at your expense; and

3rd Offense in 7 years: A category C non-probational felony punishable by a sentence of imprisonment in the Nevada State Prison for not less than 1 year nor more than 5 years and a possible fine of not more than $10,000 plus administrative assessments.
